Terms and Conditions
The terms that apply when you buy from our shop, ask us for a quote, or have us install a system.
These terms apply to this website, to anything you buy from our shop, and to installation work we carry out. In them, we and us mean Floor Heating Systems Pty Ltd, and you means the person or business buying from us. If anything here is unclear, call us on 02 9829 2752 or email bernard@floorheating.com.au before you order.
Accepting these terms
Using this website, placing an order, or accepting goods from us means you accept these terms. We may update them from time to time. The version on this page at the time you order is the one that applies to that order.
What is on this website
We put the information here in good faith and keep it current. It is general information rather than advice about your particular floor, and nothing on this website is a binding offer to supply.
Product descriptions, specifications and images are as accurate as we can make them. Where a manufacturer changes a product, the goods you receive may differ slightly from the images shown.
Quotes
Quotes are free. We quote for materials from the plans or photographs you send us. If you want us to do the work, the installation labour is a separate quote.
A quote is based on the information you give us, so it holds only if that information is right. Unless we say otherwise, a quote stays open for 30 days from the date we issue it.
If the work turns out to differ from what was quoted, we will come back to you before going any further. Any change to the agreed scope can change both the price and the date.
Installation work
Where we install, the work is done by our installer, who is a licensed electrician, subject to checking installer availability. You need to give us safe access to the work area on the agreed day.
The floor has to be prepared and ready before we arrive. Preparing it is not part of our work, and neither is waterproofing, which your own waterproofer arranges. Insulation board is not part of a standard installation.
Tell us about anything hidden that could affect the work, such as concealed electrical, plumbing or communications services. You also confirm you own the property, or have the owner's authority for the work to be done.
You may use your own licensed electrician instead. Every heating product is supplied with its own installation guide, and your electrician works to that. We do not supervise that work, and we do not take responsibility for errors or damage caused by another electrician.
Prices and payment
All prices are in Australian dollars and include GST. We do not offer credit accounts. Goods are paid for in full before they are dispatched or collected.
Card payments are handled on a secure payment page operated by our payment provider, and PayPal payments are handled by PayPal. We never see or store your card number.
We price every order again on our own server before charging it. The amount charged comes from our current prices, not from anything your browser sends.
Delivery and pick up
Delivery is free on orders of $100 and over, anywhere in Australia. Below that a flat $15 applies to the order rather than to each item. Orders usually arrive in 3 to 5 business days.
You can also collect from us at 7 Koala Avenue, Ingleburn NSW 2565 free of charge, during business hours, Monday to Friday, 8am to 5:30pm. Some items are collection only, and the shop says so on the product page.
Delivery times are estimates given in good faith and are not guaranteed. Once goods are delivered to you, or to a carrier or other person you nominate, they are at your risk.
If something is wrong with your order
Check your goods when they arrive. Tell us within 7 days of delivery about any fault, shortage, damage, or anything that does not match the description or the quote.
Give us a reasonable chance to inspect the goods. If you do not tell us inside those 7 days, the goods are treated as having arrived in good order under these terms. Your rights under the Australian Consumer Law are not affected by that, and they are set out below.
Where we agree in writing that you can reject faulty goods, we will either replace them or repair them, and the choice is ours. That applies where all of the following are true.
- You told us about the fault inside those 7 days.
- The goods come back to us within 90 days of delivery, at your cost.
- The goods were stored and used properly.
- They come back in the condition they were delivered in, with the packaging, brochures and instructions in as close to new condition as is reasonable.
If you change your mind
We may agree to take back goods you no longer want and credit you for them. That is our decision rather than a right you have. A handling fee of 10% of the value of the returned goods may apply, plus any freight.
Warranty
The heating products we supply carry our own warranty, and the period depends on the product. The full terms, the four periods and how to make a claim are on our warranty page.
Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Our goods come with consumer guarantees that cannot be excluded. Those rights sit alongside anything on this page, and the wording the law sets for them is on our warranty page.
Where we are allowed to limit our liability, we limit it to one of the following, at our option.
- Replacing the goods.
- Repairing the goods.
- Supplying the services again.
- Paying the cost of having the goods or the services put right.
Cancelling an order
You can cancel an order before it is dispatched by calling or emailing us. If it has already been paid for and not yet sent, we will refund it.
We may also cancel an order, or cancel delivery, before the goods are delivered, by telling you in writing. If you have paid, we refund you in full.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss arising from goods or services we supply. That includes loss of income, loss of use and loss of opportunity.
We are also not liable for loss caused by an event outside our reasonable control. That includes fire, flood, storm, industrial action and an interruption to supply.
Website content and copyright
The text, photographs, graphics, logos and layout on this website belong to us or are licensed to us. You may view and print pages for your own use.
You may not republish or distribute any part of this website for any other purpose without our written permission. Where you send us a plan or a drawing, you confirm we may use it to quote and to carry out your job.
Privacy
Any personal information you give us through this website is handled as set out in our privacy policy.
If part of these terms does not apply
If any part of these terms turns out to be invalid or unenforceable, the rest of them keep working as written.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and we each submit to the non exclusive jurisdiction of the courts of that state.
